Working on farmland in Delta
Delta sits on the flat, silt-rich floor of the Fraser River delta, and that geography made it one of the most productive farming municipalities in British Columbia. The regulatory picture in Delta
Two regulatory layers matter on most Delta farm parcels. The municipal layer is Delta’s Soil Deposit and Removal Bylaw No. 7221, 2014, which regulates the deposit and removal of soil and other material in the city and was written specifically with agricultural land in mind. The City’s stated concern was fill being placed in volumes and locations unnecessary or inappropriate for farmland, and the bylaw’s purpose is more effective control over soil movement on agriculturally zoned land and better protection of the agricultural land base for future productivity. The working instrument is the Soil Deposit Permit, applied for through the City with supporting documentation. The provincial layer is the Agricultural Land Commission. Where a parcel is in the ALR, uses beyond farming, subdivision, exclusion, and the placement or removal of soil each engage provincial requirements in their own right, separate from the municipal permit. Many Delta projects need both layers, and the order of operations matters. Decisions rest with the City and with the Commission; our role is to put a complete, technically defensible file in front of each.
